By placing an order through the website, you acknowledge that you have read and accepted these Terms & Conditions.

1. THE WORKS

The website offers original paintings, objects and other works created by Elisia Poelman.

Each work is described as accurately as possible, including its title, medium, dimensions, year and other relevant information.

As original artworks are individual pieces, variations in colour, texture, surface and finish are inherent to the nature of the work and do not constitute a defect merely because they differ from their appearance on a screen.

Colours may also vary depending on the device or screen on which an image is viewed.

2. AVAILABILITY

Works offered through the website are subject to availability.

Where a work is unique, it can only be sold once.

Elisia Poelman reserves the right to correct errors concerning availability, pricing, descriptions or other information displayed on the website.

If an artwork is unavailable due to an error and an order has nevertheless been placed, the order may be cancelled and any payment received for that unavailable work will be refunded.

3. PRICES

All prices are displayed in euros.

Applicable taxes are included where required by law.

Delivery costs and other applicable charges are shown separately before the order is completed.

Prices may be changed at any time. Changes do not affect orders that have already been accepted.

4. ORDERS

An order may only be placed for an artwork that is available for purchase through the website.

Before completing an order, the customer is responsible for checking the artwork, dimensions, price, delivery information and other relevant details.

An order becomes binding once it has been successfully submitted and payment has been authorised or received, subject to Elisia Poelman’s right to refuse or cancel an order where permitted by law.

An order confirmation will be sent by email.

If an order cannot be fulfilled, any payment already received for the affected order will be refunded.

5. PAYMENT

Payment is processed through WooPayments.

The payment methods available at checkout are displayed during the ordering process.

Full payment is required before an artwork is dispatched or delivered unless another arrangement has been expressly agreed in writing.

6. DELIVERY

Delivery is available only to the destinations and under the delivery conditions displayed during checkout.

The customer is responsible for providing a complete and accurate delivery address and for ensuring that the artwork can be safely received.

Delivery dates and estimated delivery periods are indicative unless a specific delivery date has been expressly agreed in writing.

For larger works, delivery may be arranged directly by the studio or through a specialised delivery service.

Where personal delivery is arranged, the customer must cooperate reasonably in agreeing a suitable delivery appointment.

Additional delivery attempts or costs resulting from an incorrect address, failure to receive the artwork or circumstances attributable to the customer may be charged to the customer where permitted by law.

7. PACKAGING, DAMAGE & DELIVERY

Works are packaged with appropriate care before leaving the studio.

The customer must inspect the artwork upon delivery.

If the artwork arrives visibly damaged, the customer should notify Elisia Poelman without undue delay and provide clear photographs of the artwork and packaging.

Nothing in these Terms & Conditions affects mandatory statutory rights concerning non-conforming or damaged goods.

8. RIGHT OF WITHDRAWAL

Where the customer is a consumer and the statutory right of withdrawal applies, the customer may withdraw from the purchase within the legally applicable period without giving a reason.

For purchases of goods, the statutory withdrawal period generally begins when the consumer, or a third party designated by the consumer, receives the artwork.

To exercise the right of withdrawal, the customer must clearly notify:

The artwork must then be returned in accordance with the applicable statutory requirements.

Unless the law provides otherwise, the direct cost of returning the artwork is borne by the customer.

The customer is responsible for any diminished value resulting from handling of the artwork beyond what is necessary to establish its nature, characteristics and functioning.

Any refund will be made in accordance with applicable consumer law and subject to the statutory conditions for withdrawal.

Exceptions

The statutory right of withdrawal does not apply where a legal exception applies.

This may include works that have been made according to the customer’s specifications or have been clearly personalised for the customer.

Any applicable exception will be communicated where required.

Professional customers

Customers purchasing in the course of their professional or business activities are not considered consumers for the purposes of consumer protection legislation.

The statutory consumer right of withdrawal does not apply to B2B purchases unless otherwise agreed in writing.

9. LEGAL GUARANTEE

Where mandatory consumer law applies, the applicable legal guarantee of conformity applies.

For new consumer goods, Belgian law generally provides a two-year legal guarantee from delivery.

The legal guarantee applies to defects covered by the applicable legislation and does not cover damage or deterioration caused by improper use, accidents, inappropriate handling, external causes or normal wear and tear where applicable.

The customer should provide the order details and sufficient information to allow the issue to be assessed.

Nothing in these Terms & Conditions excludes or restricts mandatory statutory rights.

10. RETURNS, REFUNDS & EXCHANGES

There is no general commercial return or exchange policy beyond rights that apply mandatorily under applicable law.

In particular, artworks are not exchanged simply because the customer has changed their mind outside an applicable statutory withdrawal period.

No exchange or store credit is offered unless expressly agreed by Elisia Poelman.

Where a refund is legally required, it will be processed in accordance with the applicable legal requirements.

11. COPYRIGHT & INTELLECTUAL PROPERTY

The purchase of a physical artwork does not transfer copyright or any other intellectual property rights to the purchaser.

All copyright and intellectual property rights relating to the artwork remain with Elisia Poelman unless expressly transferred in writing.

The purchaser may display the physical artwork for private purposes but may not reproduce, scan, photograph for commercial reproduction, license, distribute, resell reproductions of, or otherwise commercially exploit the artwork or its image without prior written permission.

12. WEBSITE CONTENT

All photographs, artwork images, texts, videos, graphics, logos and other creative material published on elisiapoelman.com belong to Elisia Poelman or are used with permission.

No content may be reproduced, copied, modified, distributed or commercially exploited without prior written permission.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Elisia Poelman is not responsible for indirect or consequential loss arising from the use of the website or from circumstances outside her reasonable control.

This includes, where applicable, interruptions caused by technical failures, payment providers, delivery providers, internet services or other third parties.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.

14. FORCE MAJEURE

Elisia Poelman shall not be responsible for delays or failure to perform an obligation where this results from circumstances beyond reasonable control.

Such circumstances may include, where applicable, natural events, fire, accident, illness, transport disruption, strikes, technical failures, governmental measures or disruption affecting essential service providers.

Where such circumstances occur, performance will resume as soon as reasonably possible.

15. PRIVACY & COOKIES

Personal data provided when placing an order or contacting the studio is processed in accordance with the Privacy Policy.

Information concerning cookies and similar technologies is set out in the Cookie Policy.

16. CHANGES TO THESE TERMS

These Terms & Conditions may be updated where necessary, including where the website, services or applicable legislation changes.

The version applicable to a purchase is the version in force when the order is placed.

The latest version will always be available on this page.

17. GOVERNING LAW

These Terms & Conditions are governed by Belgian law.

Where the customer is a consumer, this does not affect any mandatory consumer protection provisions that cannot legally be excluded.

Any dispute shall be submitted to the competent court in accordance with applicable law.
